membership terms and conditions.

By signing up & purchasing a membership or pass to participate in our classes, the customer agrees to be bound by our Terms & Conditions.

We reserve the right to change, update or reissue these Terms and Conditions at any time. Any such changes will be posted on our website and the customer agrees to be bound by such changes.

References to “we”, “us” and/or “our” in these Terms and Conditions is a reference to SO Fitness Limited.

  1. Minimum term of 6 months (26 weeks). A Minimum Obligation Agreement means an agreement that has a minimum term commitment to maintain payments, post this minimum term the agreement will continue indefinitely until terminated by the customer or SO Fitness.

  2.  Payment of Fees. The client must pay all fees and charges including GST as applicable, for the term of their membership. Interest may be charged on all overdue fees and amounts at the rate of 5% per month.

  3. Weekly payment will be taken within 24 hours of the chosen date. If the date falls on a weekend day or a public holiday the time period will be within 24 hours from the start of the next business day. If no funds are in place the account will be charged with a $15 dishonor fee changed automatically to your card stored on file. (that is paid to the merchant provider).

  4. Rollover classes. Classes unused will be available for an additional 7 days following their current membership week. Following this 14-day period these classes are abandoned (no exemptions).

  5. 12 hour cancellation policy as per usual for any cancellations made within 12 hours prior to the class, or any no shows. Your Pass will be deducted if there was any cancellation or no shows.

  6. No shows to classes will be charged $5 automatically to your card stored on file for all membership tiers. A $5 late cancellation will be charged automatically to your card stored on file for GOLD membership tier.

  7. Changes in Membership Fees. Outside of any minimum term obligation agreed to by the customer, SO Fitness may adjust membership fees at any time giving 21 days’ notice.

  8. Clients can request to pause their membership for medical, travel, or personal reasons with at least 7 days’ notice. Hold limits depend on membership tier:

    • Bronze: Up to 3 weeks every 6 months

    • Silver: Up to 4 weeks every 6 months

    • Gold: Up to 6 weeks every 6 months

    During a hold, you cannot make new bookings. However, you may still use any unused classes from your previous billing cycle, as these remain valid for 14 days after they are issued

  9. One Time Registration Fee of $50 applies for all new membership applications. There will be no additional registration fee charged with a contract auto renewal.

  10. Termination/Changes. If the client wishes to terminate their agreement or change their membership type, they must give 4 weeks’ notice. If a client wishes to terminate their membership within the fixed term or minimum obligation period, the client must pay a cancellation fee of $150.

  11. Overdue payments. If a balance is outstanding for more than 4 weeks, SO Fitness may notify any credit reporting or referencing agency of the default, and may pass the client’s debt for collection to a third party agency.

  12. Holds are not allowed to use as part of your termination period.

  13. Additional classes outside of your membership tier class allocation are at a discounted rate of $15 per class, charged automatically to your card stored on file. 

  14. *Bronze Membership (3 weeks hold every 6 months (26 weeks)), Silver Membership (4 weeks hold every 6 months (26 weeks)), Gold Membership (6 weeks hold every 6 months (26 weeks))

    *Please note funds will be deducted from the card provided on SO Fitness System. If you wish for the autopay to be deducted on a different card, it will be your responsibility to contact
    admin@sofitness.co.nz to update the nominated card. Failed payment will incur a $15 penalty fee per failed transaction.
